Columbia, KY – State police say a fatal shooting in an Adair County residence will be turned over to a grand jury for further investigation, but an indictment appears unlikely.
The residence of Ozie and Evelyn Toole was broken into about 14 miles west of Columbia at 3:00 am Sunday. State police say Ozie Toole confronted the intruder and shot him.
The Adair County coroner says 21 year old Stephen Penn of Columbia died at the scene. A police report says entry was gained through a broken window.
