Morgantown, KY – Butler County Circuit Judge Ronnie Dortch is being asked to determine if a 35 year old convicted rapist should be allowed to go free or serve out a lengthy prison term.
Six years ago Ben Kiper's conviction rested solely on the testimony of his ten year old stepdaughter. there was no physical evidence, no medical exam and no testimony from any corroborating witnesses at the trial.
The girl is now 16 and she has recanted her allegations, sayingg her stepmother forced her to falsely accuse Kiper during a custody dispute.
Dortch says he must decide whether the stepdaughter was lying then or is lying now.
Kiper remains at the Green River Correctional Complex in Central City.
