Frankfort, KY – The Kentucky Supreme Court has ruled that a fetus is a person
as long as it is "viable" or capable of surviving outside the womb.
The Court ruled that the wrongful killing of such a fetus can be
prosecuted as a homicide.
The Court discards its longheld rule that a fetus was not a person,
and its death was not a homicide, until a live birth occurred.
Because a law cannot be applied retroactively, the Court upheld
dismissal of a manslaughter charge againt the defendant in
the case, Christopher Morris of Pike County.
